Goshen Inland Wetlands & Watercourses Commission

Present: Chair Lorraine Lucas, Vice Chair Tom Stansfield, Commissioners Devin Stilson, Dante Malanca, Adam Andrusia, Ray Turri and Matt Wheeler. Enforcement Officer Spencer Musselman was also present.
Public Hearing: Ikes Auto Body, 225 North Goshen Road; The Show Cause Hearing continued regarding alleged illegal dumping. Chair Lucas read an email received on Feb. 5 from Osvaldo Desouza (owner). The email revealed that Daniel Cusano of Amity Excavation and Construction Services has been hired to identify and manage all aspects of the site. They have also engaged Mitchell Chester from Chester Environmental Associates to be present on excavation days. The email confirmed that they will follow the original plan to identify what is below the surface, excavate, place materials in proper containers, and transport them to a licensed facility. Osvaldo also asked that no one trespass on his private property. Chair Lucas reminded that the wetlands must be flagged by April 15. She indicated that the purview of the Commission is within a 100-ft review area of the wetlands. Mr. Musselman mentioned that Planning and Zoning has a separate Cease and Desist order in place and questioned jurisdiction. He will be reaching out to the town attorney to discuss.
The Commissioners continued their discussion: Wetlands must be flagged before excavation begins. It was asked whether Chester Environmental can flag the wetlands. Recent site activity was discussed including plowing and the presence of pink dumpsters. It was stated that a careful, thoughtful, examination should happen before excavation, and the attorney will most likely concur that we should wait until the wetlands are flagged. It was determined to table the hearing until the May meeting. The Commissioners unanimously voted to table the public hearing.
Approval of the minutes: The minutes of January 8, regular meeting, January 20 and January 22 special meetings were discussed, amended, and approved by the commissioners.
Agent Determination: While no formal report was provided, Mr. Musselman will keep everyone updated on 225 North Goshen Road.
Other Business Proper to Come Before the Commission:
Section 4.1 permitted uses of right: Discussion occurred around redoing forms and applications using resources from surrounding towns. The associated fees are average but could look at possible increases.
IWC 2026 2027 Budget: Discussion of the Inland Wetlands budget occurred. The clerk will follow up on some commissioner questions. The Commissioners approved the 2026-2027 budget with an increase to office hours and supplies.
