Jared Denis, on behalf of West Goshen Properties, 660 and 664 Sharon Turnpike, withdrew an application to rezone both properties to the Center Business Zone (CB). There was no explanation or discussion.
Extension of the Center Business zone to sites outside the town center has been the topic of discussion and some controversy at several previous PZC meetings. The Commission has also discussed creation of a different business zone, as it continues to work on drafting an updated Plan of Conservation and Development (POCD).
POCD discussion focused on the Housing section, as commissioners tried to reconcile demographic data from different sources and time periods.
Spencer Musselman reported that there were 248 responses to the Commission’s POCD survey. “Housing was the big thing people were dissatisfied with,” he said. The commissioners scheduled a Special Meeting for July 9 to try to complete their review of the Housing section.
Zoning Enforcement Officer (ZEO) Marissa Wright updated several ongoing situations in her ZEO report.
54 Bare Hill Road, site of the Forsaken Lands Haunted Attraction, is still in the process of removing materials from the site. No final completion date has been confirmed.
225 North Goshen Road, site of alleged unauthorized dumping, has a “wetland scientist, Martin Brogy, that performed a partial wetland report and flagging on that property,” Wright reported. “The Wetlands Commission actually requested the full assessment and flagging of the entire property,” she said.
70 Turkey Hollow Lane, the site of a gravel quarry operated by Pine Valley Materials, will be the subject of a public hearing to be held by the Zoning Board of Appeals (ZBA) on July 16 at 7:30 pm. Owners of a neighboring property on Thompson Road, Nic and Teri Galluccio, had filed a series of complaints against the quarry for alleged zoning violations, claiming that although the quarry had been in operation prior to establishment of the town’s zoning ordinance, operations had been improperly expanded. ZEO Wright visited the site on April 24 and determined that “activities in the subject property were in compliance with the historic use of the property and in compliance with the zoning regulation of the Town of Goshen.” The Galluccio’s appealed that decision to the ZBA.
81 Kubish Road and 192 Kubish Road. Multiple complaints were received from Buzziena White regarding reported wetland and zoning impacts on her property regarding 81 Kubish Road. In an email to the commission from White, she described a “massive unpermitted excavation project and the construction of the large dirt jump course at 81 Kubish Road (operated by Earth Tech LLC).” She wrote: “The operators heavily modified the terrain without municipal engineering oversight or permits. Most critically, they excavated and buried a deep utility line running from the utility pole located directly on our property, underneath Kubish Road, and straight up the steep slope to their house.” During an earlier visit to the site by Wright and the Inland Wetlands & Watercourses Commission chair, no violations were found. A second visit will be scheduled by Wright with PZC Chair Jon Carroll.
AJ’s Steak & Pizza restaurant was the target of a complaint by neighbor Kim Durham, citing loud noise and smell.
80 Holmes Road. Mike’s Beehives was the target of reports alleging operation of an unapproved commercial retail business in RA5 Zone. Determination is to be made by the ZEO.
